Judge dismisses murder charge against the father of "Baby Kate"

A judge says there’s no clear evidence Baby Kate was murdered when she went missing three years ago. The Ludington Daily Newsreports a murder charge against the baby’s father has been dismissed.

Sean Phillips is in prison and will remain there. He’s already been convicted in the case of his daughter’s disappearance. The charge was “unlawful imprisonment.”

Later prosecutors, with the help of the state Attorney General, also filed an open murder charge against Phillips.

The court says the only evidence Baby Katherine Phillips died comes from a letter Phillips wrote to Kate’s mother. In the letter, the judge says, Phillips also claims it was an accident. There’s also another claim that Phillips might have organized an illegal adoption.

The Attorney General’s office quickly issued a press release vowing to appeal.
